Our client came to a 4-way intersection controlled by stop signs on a rainy evening. After coming to a stop and waiting for her turn to enter the intersection, she was unexpectedly T-boned by the Defendant. The Defendant claimed our client ran the stop sign and was the sole cause of the crash. The Defendant also disputed that our client’s injuries were caused from the crash and pre-dated the accident. Client underwent 2 level cervical disc replacement with subsequent 2 level anterior cervical discectomy and fusion. During the Defendant’s deposition we were able to get him to conceded he did not come to a complete stop at the intersection before entering. We were able to get the responding officer to testify at deposition that the physical evidence he observed at the scene supported our client’s version of how the crash occurred. To refute the claims that our client’s injuries pre-dated the crash with provided a detailed medical chronology outlining no prior injuries or complaints of neck or back pain. The case resolved for policy limits shortly after.
