Our client was driving a motorcycle on a 2 lane road when the Defendant made an unexpected left-hand turn in front of him. Our client filed his lawsuit against the driver who hit him and the vehicle owner. The Defendants claimed our client was speeding and was the sole cause of this crash. Our client underwent a shoulder arthroscopy, a carpal tunnel release, a 1 level anterior cervical discectomy and fusion and a 1 level cervical radiofrequency ablation. Early in the case, our client allowed our office to file strategic proposals for settlement to try and resolve his case against the Defendant Driver and pursue the case against the Defendant Owner. These offers were allowed to expire. In addition to the liability defense raised, the Defendants claimed our client’s injuries pre-existed the crash. Our client had an extensive prior history of work related injuries to his neck, shoulders and back based on his job as a first responder. The defense also disputed our client’s need for future medical treatment based on him being cleared to return to work as a first responder after his surgery. During our client’s deposition he was able to distinguish his prior work injuries from those sustained in this crash. We then proceeded to educate the insurance carriers involved through multiple demands how we would be able to defeat the liability defenses raised and their claims that our client’s injuries pre-dated the crash. We also showed how the carriers would be responsible for 7 figures in attorney fees if this case was tried based on them allowing our client’s proposals for settlement to expire. The case resolved for policy limits shortly after our client’s final policy limit demand prior to trial.
