Our client was driving a motorcycle straight in the center lane of a 3 lane road when the Defendant unexpectedly pulled out in front of him from the exit of a shopping plaza controlled by a stop sign which caused our client to rear-end the Defendant. The Defendant claimed our client was speeding and was the sole cause of this crash. Our client sustained a butterfly pelvis fracture which required an open-reduction and internal fixation to repair. During the Defendant’s deposition, we were able to get the Defendant to admit she did not come to a complete stop at the stop sign before making her right-hand turn and also did not enter the immediate right-hand lane as she was required to as she exited the shopping plaza and entered the road. The case resolved for policy limits shortly after this deposition.
