Mr. Barnes served as lead litigation and trial counsel representing a certified class of nearly 1,000 end-stage lung disease patients who alleged that Lung Institute engaged in deceptive and unfair trade practices by marketing a blood-based stem-cell therapy as capable of regrowing, regenerating, and renewing lung tissue. After nearly a decade of litigation, including successful class certification and appellate affirmance, the case proceeded to jury trial. The jury found in favor of the plaintiff class, resulting in a final judgment of approximately $14.1 million, exclusive of any future award of attorneys’ fees and costs. Evidence at trial showed the treatment provided little to no therapeutic benefit, with testimony characterizing it as a “pig in the poke.”
