Our client’s husband was the unfortunate victim of the Defendants’ negligence resulting in his untimely death. Our client was operating a forklift on the Defendant’s property, which was not equipped with a seatbelt. While operating the forklift, our client accidentally rode over an unlit, uneven work surface that had fallen into disrepair. The forklift rolled over, ejected our client, and crushed him. Prior counsel believed the claim was exempted by worker compensation laws. We discovered that a separate corporation, albeit with similar officers as the employer, owned the property. We were able to avoid work comp immunity and obtain a full policy limits settlement against the property owner in the amount of $2,000,000. During the lawsuit we discovered a maintenance company responsible for the condition of the forklift and lack of seatbelt. The litigation remains pending against this Defendant.
