Who can bring a personal injury or wrongful death claim?

A personal injury claim can typically be brought by the injured party themselves. In cases where the victim is incapacitated, a minor, or has passed away, a legal guardian or family member may bring the claim. In a wrongful death matter, an estate representative of the deceased person must be appointed to bring the claim. Our lawyers and the firms with which we work regularly assist clients through this process.
