Our client was forcibly removed from an establishment by a bouncer. The Defendant claimed our client was asked to leave and refused which justified removal by force. Our client denied this happened. Our client underwent shoulder arthroscopy and 3 level anterior cervical discectomy and fusion. During the bouncer’s deposition we were able to get him to concede that he had not received training on when force should or could be used to remove a patron. He also conceded that our client was not a threat to himself, others or the establishment’s property. Our client was not acting belligerent and the bouncer had no reason to believe our client was under the influence of alcohol at the time. The bouncer testified he decided to use force because management told him they wanted our client removed. Shortly after this deposition, the security company resolved the case for limits.
