Our client was traveling through an intersection when the Defendant unexpectedly made a U-turn in front of him causing a T-bone collision. Client underwent shoulder arthroscopy, 2 level cervical disc arthroplasty and a 3 level cervical radiofrequency ablation. The Defendant claimed our client was speeding and caused the collision. The Defendant also claimed our client’s injuries pre-dated this crash and were related to 3 prior accidents our client had been involved in a few years before our crash. During the Defendant’s deposition, he conceded he was confused at the time of the crash because he was looking for a hotel and not paying as close attention as he should have been. He ultimately stated under oath the crash was solely his fault. Shortly after this deposition the Defendant changed his position and admitted liability. The case continued on the Defendant’s claim that our client’s injuries pre-dated our accident. We were able to systematically refute these claims during the depositions of the Defendant’s medical experts who all eventually admitted that this significant crash could have aggravated our client’s pre-existing medical condition. This case resolved shortly after discovery closed and prior to trial.
