Our client was driving a motorcycle on a 2 lane road when the Defendant made an unexpected left-hand turn in front of him. Our client filed a lawsuit against the at-fault driver and his underinsured motorist carrier. The Defendants claimed our client was speeding and the sole cause of the crash. Our client sustained a wrist fracture that required an open reduction and internal fixation to repair, as well as a ankle arthroscopy and debridement. During the Defendant Driver’s deposition we were able to get her to concede that she failed to confirm oncoming traffic was not approaching before making her left-hand turn. Shortly after this deposition we were able to get the underinsured motorist carrier to tender its policy limits. We then went back and used this tender to put pressure on the Defendant’s Driver’s insurance carrier to tender her policy limits arguing a separate insurance company evaluated this case above the Defendant Driver’s policy limits. The case settled shortly after this demand for the Defendant Driver’s policy limits.
