Pedestrian matriarch was hit and killed by a vehicle leaving a commercial property resulting in her death. While the decedent was significantly comparative negligence, we were able to obtain a recovery significantly in excess of the at fault driver’s insurance limits. During discovery, we found evidence of the landowners’ contributing responsibility for this tragic event, who had not been identified as an at fault party during the pre suit phase of the case. We successfully pursued additional claims against the landowner and its maintenance company, who allowed overgrown vegetation to obstruct the view of customer’s exiting the property.
