Our client was a passenger in a vehicle that was sideswiped by the Defendant Driver. Our client filed her lawsuit against the Defendant Driver, the Defendant Driver’s Company who rented the vehicle he was operating and 2 underinsured motorist carriers. Our client underwent a shoulder arthroscopy and sustained a traumatic brain injury. The Defendants initially disputed sole responsibility for the crash but after initial discovery was exchanged, our office uncovered an additional umbrella policy which a different insurance carrier that was not previously disclosed by the Defendant Driver and Defendant Company. Our office than crafted a negotiation strategy and strategically resolved our client’s case against the underinsured motorist carriers, 1 for policy limits. We then proceeded to leverage the non-disclosure of the additional umbrella policy, along with the differing case valuations between the remaining insurance companies to negotiate a very favorable settlement for our client.
